Sea Sag Harbor LLC Terms and Conditions

These terms and conditions apply to all charters operated by Sag Harbor LLC on the vessel “Smugairle Róin” (the “Vessel”) for a maximum of six passengers.

1. Booking & Payment

  • A 50% deposit is required to secure your booking on Smugairle Róin; the balance is due on the day of the charter.

  • Your booking is not confirmed until the deposit is received and written confirmation is sent by Sag Harbor LLC.

  • Rates are as quoted in your confirmation and may exclude additional fuel surge charges, taxes, or gratuities as specified.

2. Cancellations & Weather

  • Guest cancellations more than 48 hours before the charter start time: deposit is refundable.

  • Cancellations within 48 hours of the start time: deposit is non‑refundable.

  • Weather / safety: If, in the captain’s sole judgment, conditions are unsafe (including, but not limited to, weather, visibility, traffic or mechanical issues), the charter on Smugairle Róin may be cancelled or postponed.

    • In these cases, a reschedule will be offered at no extra charge, or a credit issued.

  • Late arrival may shorten your charter with no refund for lost time.

3. Captain’s Authority & Safety

  • The captain of Smugairle Róin is in full command of the Vessel at all times; all guests must follow the captain’s instructions promptly.

  • The captain may limit or stop alcohol service and/or consumption, alter the itinerary, restrict swimming, or end the trip early without refund if guest behaviour is unsafe or non‑compliant.

4. Conduct On Board

  • No dangerous, disruptive, or illegal behaviour on board or in the water.

  • No excessive drinking. If guests are visibly intoxicated or behaving unsafely, the captain may terminate the charter without refund.

  • No red wine or other staining drinks/foods on board unless agreed in advance by Sag Harbor LLC.

  • No smoking or vaping except in any area expressly designated by the captain.

  • Illegal drugs of any kind are strictly prohibited and may result in immediate termination of the charter and notification of authorities.

5. Alcohol & Age Requirements (New York)

  • Guests consuming alcohol must be 21 or older and may be asked for valid photo ID.

  • The captain may refuse alcohol to any guest at their discretion (including guests who appear under‑age or impaired).

6. Swimming & Water Activities – At Own Risk

  • Swimming, entering the water, and water activities are strictly at guests’ own risk.

  • All guests must use life jackets and safety gear as directed by the captain or crew.

  • Children must be closely supervised by a responsible adult at all times.

  • The captain may prohibit or stop swimming or water activities at any time for safety reasons (including weather, current, traffic, visibility, or guest behaviour).

7. Life Jackets & Children (NY Law)

  • In line with New York requirements, children under 12 must wear a U.S. Coast Guard–approved life jacket while on deck when Smugairle Róin is underway.

  • Sag Harbor LLC strongly recommends that all guests wear life jackets while underway or when conditions are rough.

8. Damage, Loss & Cleaning

  • Guests are responsible for any damage to Smugairle Róin, its furnishings, or equipment caused by their actions or negligence (including spills and stains).

  • An additional cleaning fee may be charged for excessive mess, spillages, or soiling beyond normal use.

  • Sag Harbor LLC is not responsible for loss, damage, or theft of guests’ personal property on board or in the water.

9. Health & Fitness

  • Guests must inform Sag Harbor LLC of any medical conditions, mobility limitations, or special needs that could affect safety on board.

  • Sag Harbor LLC and/or the captain reserve the right to refuse boarding or participation (without refund) to any guest who appears intoxicated, aggressive, or otherwise unsafe.

10. Liability & Assumption of Risk

  • Guests understand that boating and water activities on Smugairle Róin carry inherent risks, including risk of injury or death, and voluntarily choose to participate.

  • To the fullest extent permitted by New York law, Sag Harbor LLC and the captain are not liable for injury, loss, or damage arising from inherent risks or guest negligence.

  • Guests agree to indemnify and hold harmless Sag Harbor LLC, its owners, employees, and the captain from claims arising from their own acts, omissions, or breach of these terms.

11. Force Majeure

  • Sag Harbor LLC is not responsible for cancellations, changes, or delays due to events beyond its reasonable control (including severe weather, mechanical failure, government orders, emergencies, etc.). In such cases, Sag Harbor LLC will work with you to reschedule when possible.

12. Acceptance of Terms

  • By paying the deposit and/or boarding Smugairle Róin, you confirm that you and all other passengers forming part of your charter bookng (maximum 6 total) have read, understood, and agree to these terms and conditions with Sag Harbor LLC.
